The purpose of the law is the objectively determined need to model the legal regulation of civil-law relations between the performer and the consumer regarding the provision of digital content and (or) a digital service on the basis of a contract, as well as the legislative establishment of an effective legal instrument for the protection of the rights of consumers who are provided with digital content and (or) digital service.

The law defines the sphere of civil legal relations to which its provisions apply, distinguishes subjective and objective criteria for compliance of digital content and (or) digital service with the terms of the concluded contract, establishes the legal consequences of not providing digital content and (or) digital service under the contract, and as well as non-compliance of the provided digital content and (or) digital service with the requirements, the grounds and legal consequences of the refusal of the contract under which the digital content and (or) digital service is provided are determined.

Sanctions in the form of a fine are applied to business entities for violating the requirements of the law .

In the event of a violation of consumer rights related to the provision of digital content and/or a digital service — in the amount of ten times the value of the digital content and/or digital service, based on the prices in effect at the time of purchase of such digital content and/or digital service , but not less than five tax-free minimum incomes of citizens.

At the same time, in case of violation of consumer rights related to the compliance of digital content and/or digital service, in the amount of 300 percent of the value of the provided digital content and/or digital service in violation of the requirements of this law regarding the compliance of digital content and/or digital service, but not less than 25 non-taxable minimum incomes of citizens, and in the event that, in accordance with the law, the business entity does not keep mandatory records of income and expenses or if the digital content and/or digital service was provided in exchange for the consumer’s personal data – in the amount 50 tax-free minimum incomes of citizens.

It is expected that the law will contribute to the effective implementation and protection of the rights of consumers who are provided with digital content and (or) a digital service under the contract, as well as the determination of clear trends towards the formation of an effective market.

The Verkhovna Rada Committee on Digital Transformation submitted draft law No. 9463 aimed at improving the provisions of the legislation in the field of electronic communications. One of its key provisions is the legislative consolidation of national roaming for settlements with a population of up to 2 thousand people.

According to the Minister of Digital Transformation Mikhail Fedorov, the law on national roaming will provide access to 4G communications in villages, allow monitoring the speed of the Internet, and also allow residents to influence the quality of the Internet connection.

The new bill assumes that national roaming will guarantee the availability of communication in remote settlements, regardless of the mobile operator whose services the subscriber uses. This is especially true for those settlements where only one operator is currently represented. According to the State Statistics Service, there are 5529 such settlements in Ukraine, and this limits the choice of residents in terms of quality communications.

The adoption of draft law No. 9463 also provides for the creation of conditions for improving the quality of voice communications and ensuring coverage of 90% of the population with a data transfer rate of at least 2 Mbps. Such renewal of communication networks will contribute to more stable operation and meet the needs of residents of small settlements.

According to the new law, the data rate for radio frequencies in the 900 MHz bands will be officially defined as a quality indicator. Citizens will be given the opportunity to conduct speed tests and report places where there are communication problems. Thus, a low data transfer rate will become the basis for taking measures to improve the quality of communication in a particular location.

Representatives of the committee hope for broad support for bill No. 9463 from the deputies of the Verkhovna Rada. In particular, Mikhail Fedorov believes that the adoption of this law will help get rid of problems with poor communication, which limits the development of small settlements. These changes in legislation will significantly improve the quality of life and communications for residents of rural areas of Ukraine.

Japanese scientists have developed a new navigation technology.

Japanese engineers from the University of Tokyo have introduced an innovative technology called the Muometric Wireless Navigation System (MuWNS). This system, based on the use of cosmic rays, can become an analogue of satellite navigation for basements, caves, underground spaces and underwater. A team of researchers has successfully developed and tested this technology, which allows indoor movement to be tracked with high accuracy – up to a couple of meters.

Working with muons

The main advantage of the MuWNS system is its ability to operate in environments where traditional navigation systems such as GPS encounter physical obstacles. MuWNS uses muons, particles that can penetrate rock and water, instead of the radio signals used by GPS or GLONASS.

Field trials

The first field tests of the MuWNS system showed its high efficiency. The scientists set up four muon detectors on the sixth floor of the building, and the subject was in the basement with a fifth, portable unit. The subject’s location was determined using triangulation, similar to the operation of GPS and other satellite systems.
